Please read these Terms carefully before using the Site, as they contain important information regarding limitations of our liability and the relationship between you, Balto, and our operating company, Northern Pacific Power Systems ("NPP"). These Terms apply to all visitors and users of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you may not access or use the Site.
About Balto and the Site. Balto Energy, Inc. is a financer of residential energy equipment. The Site is where homeowners can provide home owner information about their home, energy bills, and energy goals so that we and NPP can evaluate eligibility for residential energy financing and arrange installation. Home owner information you submit through the Site is shared with NPP, a licensed installer, who uses it to evaluate eligibility, prepare quotes, and arrange installation by licensed contractors. Use of the Site does not, by itself, create any financing or service relationship with you. Financing relationships (under which Balto may own equipment installed at your site) and service relationships (under which a licensed operating company performs installation and ongoing service) are established only through separately-executed customer agreements between you and the relevant party. Our handling of home owner information is described in our Privacy Policy.
The Site is intended for users who are at least 18 years of age.
Accounts
If the Site allows you to create an account, you confirm that you are at least 18 years of age and that the home owner information and other account information you provide is accurate, complete, and current. You are responsible for maintaining the confidentiality of your account and password and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate any account at our sole discretion. You may terminate your account at any time by contacting us at team@baltoenergy.com.
Prohibited Uses
You agree to use the Site only for lawful purposes and in accordance with these Terms. The following is a non-exhaustive list of prohibited uses; you agree not to:
- Misrepresent your identity, affiliation with any person or entity, or the home owner information you submit;
- Submit false, fraudulent, or misleading home owner information;
- Send or attempt to send any unsolicited advertising, spam, or chain mail through the Site;
- Engage in any conduct that restricts or inhibits any other person's use of the Site;
- Use any robot, spider, scraper, or other automated means to access, monitor, or copy material from the Site without our prior written permission;
- Use any device, software, or routine that interferes with the proper working of the Site, including viruses, trojan horses, worms, or other malicious code;
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt the Site, the servers on which the Site is stored, or any related systems;

Governing Law, Severability, Dispute Resolution and Venue
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved exclusively in the state and federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts and waive any defense of inconvenient forum. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site.

Your use of the Site is also governed by our Privacy Policy. The Privacy Policy describes how we collect, use, share, and protect home owner information you provide through the Site, including the sharing of home owner information with NPP for quote generation and installation.
